Your participation on any Freak Fest Adventure Tours trip (herewith named FFAT) is governed by the terms and conditions set forth below. By pressing "I AGREE" on the TERMS and CONDITIONS page, I am confirming that I have read, understand, voluntarily agree without inducement, and accept each and all terms, conditions and policies set forth by FFAT, that I have availed myself of the opportunity to seek independent legal advice, read, and understand the terms hereof and voluntarily sign this document.

PASSPORT AND TRAVEL INSURANCE are MANDATORY for ALL FFAT trips!

PASSPORTS-US Passports valid for at least 6 months from the date of departure are mandatory for US citizens when traveling to all foreign countries (including Mexico). Visas are mandatory for US citizens traveling Indonesia. Visas for Indonesia are issued upon arrival and price for visa is included in the Indonesian Experience package price. IMPORTANT: For Non US Citizens (foreign nationals) many countries require visas to enter. It is critical that you consult the Consulate offices of the destination country in order to verify the visa requirements for you to enter that country, and this must typically be done well in advance of travel as some visas can take up to several weeks to obtain.

TRAVEL INSURANCE-For your protection, travel insurance is mandatory for all FFAT trips. FFAT suggests such insurance through InsureMyTrip.com soley as a convenience to you and is not responsible for any claim, liability, loss or damage resulting from the purchase or failure to purchase such insurance. Some trips may have Travel Insurance included. Please see details on specific trip package page for more details.

1. VALIDITY
Please check our website (www.ffat.biz) for the tour package dates and make sure it is current.  We often change tour options when we update the website we so cannot guarantee the option is available if the website is not current.

2. HOW TO BOOK
We recommend booking well in advance by sending a non-refundable deposit (check website for specific tour deposit/payment details). Your registration for a FFAT trip is confirmed ONLY when FFAT headquarters in San Diego, California has received and accepted your deposit of at least $100.00 and your completed Application, which must be legible. You should be advised that the deposit reflects the administrative cost of securing confirmed hotel space and transportation and is non-refundable and non-transferable. Deposits and other payments may be made by money order, PayPal or PayPal accepted credit cards. Please note: FFAT, PayPal or anyone for that matter will not ask for your Password…ever! A booking confirmation email will be sent and will include the exact deposit amount paid and the due date of secondary payment and/or final payment (check website for specific tour deposit details) will be sent upon receipt of the above items. Receipt of non-refundable deposit will be taken as an understanding by FFAT that the participant has checked their confirmed travel arrangements and has read and agrees to abide by the terms and conditions set forth. Any verbal quote given is an estimate only of the price, which will be subject to advice on confirmation of the reservation. Bookings are subject to availability and are confirmed on a first come, first serve basis. We recommend booking as soon as possible as some FFAT trips will sell out.

3. PRICE GUARANTEE
Prices on www.ffat.biz are based on costs and exchange rates as at the time of posting. Should these costs change it may be necessary to make a surcharge on the price of your tour package. However, no surcharge in respect to cost or currency fluctuations will be made to the arrangements of your tour package once full payment has been received by FFAT. This does not apply to any tax charges or levies imposed by any government or their agencies. The air content of tours is based on airfares applicable as at the date of purchase. As airline prices are constantly changing it may be necessary to impose an air surcharge any time up to departure.

4. AMENDMENTS
Should you alter your arrangement after your original booking a fee will be levied to cover extra administrative and communication costs in addition to any applicable supplier charges. In addition to the above FFAT fee, amendment and/or cancellation charges may be imposed by the supplier depending on the nature of the change.

5. LATE BOOKINGS
A fee of $50 per booking will be levied for bookings made within 31 days of departure date. Any booking request made within one month or within a supplier cancellation period cannot be processed until full payment has been received by FFAT.

LATE BOOKINGS
-A fee of $50 per booking will be levied for bookings made within 30 days of departure date.
-No bookings will be accepted 14 days prior to departure date.

6. CREDIT CARDS
FFAT will accept credit card payments via PayPal only. An additional service fee will be applied to the dollar amount paid by credit card. This fee is determined by the cost of PayPal's transaction fees plus FFAT fees. These fee are and will be non-refundable. The fee has been established at 3.5% as of January 1, 2007. This rate is subject to change at any date.

7. CANCELLATIONS AND REFUNDS - LAND ARRANGEMENTS
Due to the fact FFAT must make commitments with its suppliers long before a trip begins, deposits and final payments are subject to all cancellations fees. We strongly recommend you purchase supplemental trip cancellation insurance. FFAT suggests such insurance through InsureMyTrip.com solely as a convenience to you and is not responsible for any claim, liability, loss or damage resulting from the purchase or failure to purchase such insurance. 30 Days & Under 100% Trip Cost
In addition to the forementioned fees, all fees assessed by Pay Pal during the booking process are non-refundable.

8. CANCELLATIONS AND REFUNDS - AIR ARRANGEMENTS
Cancellation fees will apply as required by airlines regulations and will vary dependant upon the type of airfare utilized. Airfare prices and conditions are subject to change or withdrawal without notification until ticketed. Full payment is required to airline or agency before tickets can be issued. FFAT cannot be held liable for any increases in prices or changes in the rules and conditions. Foreign currency airfares and airport taxes may fluctuate and are subject to the rate of exchange on date of ticket issue. Increases in airport taxes are not the responsibility of FFAT and can be imposed up to departure. Once tickets have been issued, some airlines will not refund the cash value of ticket. A voucher for the amount of the ticket will be in the traveler's name will be issued instead. All fees assessed by Pay Pal during the booking process are non-refundable.

9. CONSUMER CLAIMS
Should you encounter any problems on your holiday, it is always better to try and solve it directly with the supplier. If it is not possible to do so and you wish to lodge a complaint please do so in writing within 30 days of completing your FFAT arrangements. This is not a school or district sponsored event. California Seller of Travel Law: FFAT is a participant in California’s Travel Consumer Restitution Fund, (“The Fund”) CST #2079488-40. California Law requires certain sellers of travel to have a trust account or bond. This business has a trust account. Registration as a seller of travel does not constitute approval by the State of California. A claim can be filed with the Travel Consumer Restitution Corporation (Office of the Attorney General) within 60 days of the date that persons suffer or become aware of loss. Participants located outside of California are not covered by this fund. You are not eligible to file a claim against The Fund in the event of FFAT’s default. These are not School or District Sponsored Events.

11. CHANGES IN PRICES AND ITINERARIES
Considerable care has been taken to compile the information on this website but circumstances may necessitate changes in itineraries and costs in which case you will be informed as soon as possible. FFAT cannot be held responsible for any changes which may occur and reserves the right to increase the price of any travel arrangement up to the date of departure. This includes adjustment for devaluation fuel surcharges airfare increases as well as international exchange rate fluctuations.

12. TOUR PACKAGE VARIATIONS
Sometimes forces beyond FFAT’s reasonable control (i.e. storms, road closures, etc.) cause the Adventure to be modified. In such case, FFAT reserves the right to implement such modification(s) without prior notice when necessary. Please note that no price reduction or partial refund will be offered if such changes are deemed necessary by FFAT. FFAT will notify you of any increase in the trip price occurring due to circumstances beyond FFAT’s reasonable control. You agree to pay any extra costs associated with such modifications or must reimburse FFAT for any such increased expenditures made on your behalf (i.e.: fuel surcharge, etc).

13. HOTEL DESCRIPTIONS, MAPS AND PHOTOGRAPHS
Hotel descriptions featured on this website are based on current hotel guides and contractual agreements provided by suppliers. Any facilities described are subject to change at any time. Maps and photographs are included for general information and may not necessarily reflect actual routings, location or services. Hotel room photographs may not be specific to the actual room occupied.

14. INSURANCE
It is highly suggeted that all participants are adequately insured for the full duration of their travel arrangements in respect of illness, injury, death, loss of baggage and personal item cancellation and curtailment (some trips include Travel Insurance). InsureMyTrip.com offers comprehensive travel insurance via its extensive partnership program. Most Travel Insurance Co. include coverage for the following: trip cancellation & interruption, baggage delay, baggage coverage, travel delay, emergency medical and dental, emergency medical transport & evacuation, and travel accident insurance. This insurance is MANDATORY for all FFAT trips. Policies typically range in cost from $40 to several hundred dollars per person depending on the amount and duration of coverage. This insurance should be purchased the day of booking or soon after. This will protect you from unforeseen cancellations.

15. AIRLINES
The airlines do not by virtue of their endorsement of this website represent themselves either as contracting with any purchaser of an air inclusive tour package from FFAT or as having any legal relationship with such a purchaser. Generally lowest cost tourist class air fares are used and they are non-refundable, non-endorsable and non changeable.
To provide you with the lowest possible airfares, FFAT takes advantage of special promotional fares. These fares can be quite restrictive and carry cancellation charges imposed by the airlines ranging from 25% to 100%. Therefore, any penalties resulting from flight changes at your request after flights are ticketed will be your responsibility. If you cancel your trip after receiving your tickets, you must return your tickets to FFAT before your refund (if applicable) is processed.

If you make your own flight arrangements, FFAT will not be responsible for any loss resulting from cancellations or changes in international gateways or travel dates. We recommend that you do not purchase tickets with high penalty charges for changes. If you make your own domestic flight arrangements and you miss your international flight for any reason, FFAT can assist with alternate flight arrangements; however, you are responsible for the cost of an alternate flight to your destination, as well as any other expenses incurred prior to joining up with your tour group.

SURFBOARDS/BODYBOARDS: IMPORTANT- Many airlines charge excess baggage fees for surfboards and/or bodyboards. Some airlines such as United, Continental and Delta most notably have EXCESS BAGGAGE EMBARGOS to many cities meaning they do not allow surfboards at all on the plane during select times of the year to select cities. Please be aware you should that booking AIRLINE TICKETS ON THE INTERNET OR THROUGH OUTSIDE AGENCIES MAY NOT TAKE AIRLINE BAGGAGE POLICIES PERTAINING TO SURFBOARDS AND BODYBOARDS INTO CONSIDERATION WHEN BOOKING YOUR TICKETS.

16. PASSPORT VISA AND VACCINATIONS
It is mandatory that you familiarize yourself with any visa and health requirements that may be applicable in the countries you are visiting. You are responsible for all entry exit health and any other documents required by laws regulations orders demands or requirements of countries visited or transited. Please note that passport and visa requirements are not the responsibility of FFAT or that of your travel agent; both parties can not be held liable for any loss or expense due to the failure to comply with the above. The Center for Disease Control maintains updated, expert information on this subject. Please review their website at: http://www.cdc.gov/travel/destinat.htm. Malaria precautions are MANDATORY for travel to Indonesia.

17. CONSULAR ADVICE
Official travel advice issued by the US Department of State is available by calling 1-888-407-4747 (from overseas: 202-501-4444) or visiting their website http://travel.state.gov. We recommend that you review this information both prior to making your booking and prior to departure.

18. UNLICENSED ENTITY DISCLAIMER
If you request FFAT to arrange for the provision of products or services by a person or company which is not licensed in accordance with any applicable law, FFAT accepts no liability (whether in contract for negligence or otherwise) for any loss or damage suffered by you as a result.

19. CLIENT TRUST ACCOUNT AND TCRC
California law requires certain sellers of travel to have a trust account or bond. This business has a trust account. This business is a participant in the California Travel Consumer Restitution Corporation (TCRC) and is covered under the TCRC Fund. All travelers located within California and purchasing a tour/trip from FFAT has a right to make a claim on the fund. If traveler is located outside of California and purchasing a tour/trip from FFAT, the Travel Consumer Restitution Fund does NOT cover this traveler.

20. CLIENT HEALTH AND FITNESS
You must advise us in writing, at or prior to booking, of any physical, emotional or mental condition, which may require professional attention during the trip or may require the use of special equipment. If you fail to disclose any such conditions, FFAT may refuse to allow you to take the trip and you will forfeit the trip cost; and in such event we shall have no liability, financial responsibility or otherwise.

If you are so challenged, you must bring and be responsible for all necessary items related to your condition. If any such condition arises after the trip is booked, you must advise us in writing immediately. Failure to advise us shall release FFAT and all professional personnel from any liability related to such condition or its treatment.

We cannot accommodate women past their sixth month of pregnancy. We also may or may not accommodate passengers requiring wheelchair assistance, as most features of FFAT trips are not wheelchair-accessible. Please contact FFAT for details.

Be advised immunizations are recommended and sometimes required on most FFAT trips. Your health and safety during your trip are our first concern, but FFAT is not a medical facility. You should be in good health to participate in our adventures.

FFAT reserves the right to decline any trip participant whose condition, in our opinion, may affect the health, safety or enjoyment of other participants.

FFAT is not responsible for the costs of any medical treatment you may require during the trip. Under no circumstances is FFAT responsible for the quality of medical care, or lack thereof, you may receive while on the trip.

21. TRAVELLING SINGLE OR COUPLES
Traveling single. If you require a single room you will be charged a single/couple's supplement fee regardless of when you book. However due to some of the remote areas visited, single rooms are limited and therefore subject to availability. Please see individual tour/trip rate charts on website for costs. Single/Couple's supplement fees vary from tour to tour. Please contact FFAT for details on your tour.

22. ROOMMATE MATCHING
If you are on a tour/trip where sharing is possible and you would like to share a room with another participant of the same gender, we will do our best to match you with a roommate.

23. TIPPING
On tours/trips where guided tours, transfer services and meals are included, it is recommended that following schedule be applied: Driver: $1.00 per person per day, for a full day. Guide: $3.00 per person per full day. For three hour city tours $1.00 to guide is recommended. Waiters/waitresses 10%-20%. Maids, generally $0.50 per person per day.

24. RESPONSIBILITY
Freak Fest Adventure Tours (herewith called the FFAT) accepts bookings subject to the following conditions.

i.   FFAT acts as a coordinator for all persons taking the tour in the making of all arrangements for transportation, sightseeing and hotel accommodations. FFAT does not own, manage, control or operate any hotel or restaurant or any other supplier of services. All coupons receipts and tickets are issued subject to the terms and conditions specified by the suppliers and all services are subject to the laws of the country where the services are provided.

ii.  A booking is accepted only after FFAT receives the deposit and issues the client a confirmation email. The balance must be paid no later than 30 days before departure otherwise FFAT will treat the booking as cancelled regardless of whether a deposit is being held.

iii.  FFAT only acts as an agent for the owners, contractors and suppliers of transportation and/or other related travel services provided and assume no responsibility for the loss or damage to baggage property or for injury, illness or death or for any damages or claims however so caused arising directly or indirectly from accidents, loss or damage to person or property, delays, transport failures, strikes, wars and uprisings or acts of God, etc. over which we have no control. Clients are strongly advised to insure adequately for the full duration of their travel arrangements in respect of illness, injury, death, baggage and personal effects.

iv.  While FFAT will use its best endeavors to operate all tours as advertised reasonable changes in the itinerary may be made without notice where deemed necessary or advisable by FFAT. No refund will be made for any unused services that are included in the tour price.

v. FFAT cannot be held responsible for any personal belongings lost, stolen or damaged.

vi. Some of the activities listed on this website have an element of danger in them. FFAT holds no liability for any accident, injury or death caused as a result of participation in such activities.

vii. The undersigned hereby WAIVES ALL CLAIMS, and RELEASES AND AGREES TO HOLD FFAT HARMLESS for, or from, all damages, whether to the person or property of the undersigned, and AGREES to INDEMNIFY FFAT for any claims or obligations arising from the negligence of the undersigned while participating in any services provided by FFAT, and AGREES to HOLD HARMLESS and RELEASE FFAT FROM ALL LIABILITY resulting from all unsatisfactory surfing conditions, inclement weather, adverse climate conditions, and/or other natural conditions beyond the control of FFAT which may adversely impact the services provided by FFAT or the expectations of the undersigned.
